Abstract:

The principle of informed consent is a cornerstone of modern medical ethics; in practice, however, it has not fulfilled what it was created to do. This paper describes the ancient foundation and recent explicit legal definition of informed consent, then proceeds to consider some defects in its institution and how they may be addressed using a framework of "engineering as social experimentation." In the end, explicit prescriptions are modestly limited to mindset shifts which should inform behavioral changes.
